What your notice must include

To be effective under the DMCA, a notice generally must include:

• Your physical or electronic signature
• Identification of the copyrighted work claimed to have been infringed (or a representative list if multiple works)
• Identification of the material claimed to be infringing, with enough detail for us to locate it (include the full URL of the post or page)
• Your name, mailing address, telephone number, and email address
• A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
• A statement that the information in the notice is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed

What we do after a valid notice

When we receive a substantially compliant notice, we will promptly remove or disable access to the identified material on SignalDesk Blog, and we may notify the publisher who filed the content. We may also suspend accounts in appropriate cases.

Misrepresenting infringement in a DMCA notice can create legal liability for the sender. Only send notices for material you are authorized to enforce.

Counter-notification

If your material was removed and you believe it was a mistake or misidentification, you may send a counter-notice to dmca@signaldesk.example that includes:

• Your physical or electronic signature
• Identification of the material removed and the location where it appeared before removal
• A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification
• Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or any judicial district in which SignalDesk Blog may be found if outside the U.S.), and that you will accept service of process from the original complainant

Upon a valid counter-notice, we may restore the material unless the original complainant seeks a court order as provided by the DMCA.

Repeat infringers

SignalDesk Blog may terminate publisher accounts that are repeat infringers in appropriate circumstances, consistent with our Terms of use.
